Fair Use Issues:
1. What Do We Need To Learn?

The Fair Use Issues topic was introduced with a debate on Priority of Legal Issues vs. Priority of Educational Issues, followed by teams of conference attendees providing the ideas that follow.

The attendees were also invited to add to their notes More Commentary on Fair Use Issues, which is reported separately from the outline of this page. The lists below focus only on responses to the first half of the Danger in the Construction Zone instructions.

  1. To achieve resolution or greater understanding of Fair Use Issues,
    WHAT DO WE NEED TO LEARN?

    Summary:

    • We need to learn the specifics of copyright law and what "fair use" means in that context.
    • We need to learn our present options of fair use, such as how to obtain permission to use copyrighted materials and what permissions are already granted to us.

    Transcriptions of Conference Notes:

    • [Multiple] Need to learn/clarify/understand details and specifics of copyright laws.
    • [Multiple] What is a violation? What are penalties? What is compliance?
    • [Multiple] We need to learn how to comply with the law.
    • Learn better definition of "fair use." Who is accountable for content? Is school accountable for student created pages?
    • Staff/Faculty need to know whether or not material is protected by copyright or trademark. If so, what can be done in order to obtain the rights to use this material?
    • Guidelines for appropriate use of copyrighted material/trademarked materials. What are restrictions/rules of use?
    • What permissions have already been granted?
    • The problem is making people aware of the law.
    • Need to learn from the legal department what is legal to use and what is not.
    • If you use the product as long as there is no profit then is there in fact a copyright violation?
    • What we need to learn: How to respect other people's property.
